Terms and Conditions

These Terms and Conditions (“Terms”) set out the agreement between you (“the Customer”) and Whisky and Waves Limited (“the Company”, “we”, “our”, or “us”) when booking or participating in any of our sailing tours or related experiences.

By booking a trip with us through our website, Viator, GetYourGuide, or any other platform, you agree to be bound by these Terms.

1. Booking and Payment

1.1 A booking is confirmed once a 20% deposit has been received.
1.2 The remaining balance is due no later than 4 weeks before departure.
1.3 If the booking is made within 4 weeks of departure, the full amount is due at the time of booking.
1.4 Payments can be made via the methods displayed on our website or via authorised booking platforms.

2. Cancellations by the Customer

2.1 Cancellations made more than 4 weeks before departure will receive a full refund of the deposit.
2.2 Cancellations made within 4 weeks of departure are non-refundable.
2.3 We recommend customers obtain suitable travel insurance to cover unexpected cancellations.
2.4 Non-arrival or late arrival: Customers who fail to arrive at the agreed meeting point or arrive too late to join the trip will be treated as a cancellation and no refund will be given.
2.5 It is the customer’s responsibility to check travel arrangements, allow adequate time for potential delays, and ensure they have accurate information about the meeting location and time.

 

3. Cancellations or Changes by Whisky and Waves Limited

3.1 We reserve the right to cancel or alter any trip due to:

  • Adverse weather or sea conditions,

  • Mechanical issues,

  • Safety concerns, or

  • Any other unforeseen circumstances.

3.2 In the event that we cancel a trip, customers will be offered:

  • A full refund, or

  • An alternative date (subject to availability).

3.3 We are not liable for any additional costs incurred by the customer due to cancellation (such as accommodation or transport).

 

4. Safety and Conduct

4.1 All participants must follow the skipper’s instructions at all times for their own safety and the safety of others.
4.2 We reserve the right to terminate participation without refund for any person whose behaviour is deemed unsafe, disruptive, or inappropriate.
4.3 Reasonable consumption of alcohol is permitted onboard. The skipper reserves the right to restrict or prohibit alcohol consumption if it poses a safety risk.

 

5. Age Policy

5.1 There is no minimum age requirement, but all minors must be accompanied by a responsible adult.
5.2 Parents or guardians are responsible for supervising children at all times while onboard.

5.3 Whisky tasting (if arranged) on board is only available to those aged 18+.

 

6. Liability and Insurance

6.1 Whisky and Waves Limited is fully insured for public liability and marine operations.
6.2 Participation in sailing carries inherent risks associated with weather, movement of the vessel, and the sea environment.
6.3 By booking, customers acknowledge these risks and agree that the Company is not liable for loss, damage, injury, or death except where caused by the Company’s proven negligence.
6.4 Customers are advised to ensure they have appropriate personal travel and health insurance.

 

7. Customer Responsibilities

7.1 Customers must inform us in advance of any medical conditions, mobility issues, or dietary requirements.
7.2 Customers are responsible for arriving on time at the agreed departure point. Late arrivals may forfeit the trip without refund.
7.3 Customers are responsible for any wilful or negligent damage caused to the vessel or its equipment and may be charged for repair or replacement costs.

 

8. Photography and Marketing

8.1 We may take photographs or videos during trips for promotional purposes.
8.2 Customers who do not wish to appear in such material should notify us prior to departure.

 

9. Health and Fitness

9.1 Sailing is an active, outdoor experience that may involve variable weather, movement of the vessel, and occasional physical activity such as stepping between pontoons, handling equipment, or moving about the boat while under way.

9.2 By booking, you confirm that you are in reasonable health and able to take part in such activities. If you have any medical conditions, disabilities, or mobility concerns that may affect your participation, you must inform us at the time of booking or as soon as reasonably possible thereafter.

9.3 Our crew are not trained medical professionals. We will, however, provide reasonable assistance in the event of illness or injury and will contact emergency services if required.

9.4 We carry standard first aid equipment on board and our skippers hold current first aid certification.

9.5 Customers must bring any personal medication they may require and are responsible for managing their own medical needs while onboard.

9.6 In certain circumstances (e.g. severe weather, prolonged sailing passages, or remote anchorages), immediate access to professional medical assistance may not be possible. By joining a trip, you acknowledge and accept this inherent limitation.

9.7 If the skipper reasonably believes that a participant’s health condition may compromise safety, they reserve the right to restrict or end that person’s participation without refund.

 

10. Data Protection

10.1 We collect and store personal information solely for the purpose of managing bookings and providing our services, in accordance with UK GDPR.
10.2 Personal information will not be shared with third parties except where required to deliver your booking (e.g. payment processors or booking platforms) or where required by law.

11. Force Majeure

11.1 We shall not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control, including but not limited to extreme weather, natural disasters, government restrictions, pandemics, strikes, or other events that make performance of the contract impossible or unsafe.
11.2 In such cases, we will make reasonable efforts to reschedule or offer a credit towards a future trip, but refunds may not always be possible.

 

12. Complaints

12.1 We aim to provide a professional and enjoyable experience for all guests.
12.2 Any complaints should be raised with the skipper or crew at the earliest opportunity so that reasonable steps can be taken to resolve the issue.
12.3 If the matter is not resolved during the trip, please contact Whisky and Waves Limited in writing within 14 days of the experience, and we will investigate promptly.

 

13. Governing Law

13.1 These Terms and any disputes arising under them shall be governed by and interpreted in accordance with Scottish law.
13.2 The courts of Scotland shall have exclusive jurisdiction to settle any disputes.
